How Loss of Income is Calculated

When you are injured and unable to work, California workers’ compensation law provides for temporary disability payments to replace some of your loss of wages during the time you are not able to work. If you miss more than three days of work, you are eligible for these payments. The workers’ compensation system replaces two-thirds of your average weekly wages, during the time you are unable to perform your work duties.

California law sets a maximum weekly wage that can be collected under workers’ compensation. This amount is based on the average weekly wage in the state and is adjusted annually. Should you remain disabled for two years after you were injured, the maximum weekly payment is determined by the amount that was in effect at the time that you were injured.

Permanent Disability

When a work-related injury results in a permanent disability, the worker is entitled to collect a permanent disability benefit. In order to qualify for this benefit, you must be permanently unable to resume the work you were doing at the time of the accident or your doctor does not think you will recover from the disability within the next year. The benefit for permanent disability is less than the weekly payment for temporary disability.
