In California, workers' compensation insurance is a no-fault system. When medical attention is needed in the workplace the employer has to comply with the no-fault policy and the employee is entitled to compensation for any damages regardless of how and why the injury happened.

A right to report

Within 30 days, it is an employee’s right to report workplace injuries. After, the employer is then required to file a claim. If the employer fails to submit a claim promptly, an employee can submit a worker’s compensation claim.
